Half Dome – Yosemite Musing

I was poking around the web today and came upon some links to Half  Dome photos. I was sent to FLICKER to view them. This is a photo sharing site. I’m a bit of a clunker when it comes to using social media, and Flicker seemed to be a nice way for photographers to share their precious shots. But have you read the Flicker Terms? Most people just hit ACCEPT thinking that the Easter Bunny and Mickey Mouse would never let anything bad happen to them. Read them again. It seems that if you post photos on Flicker (and who knows what other sites), the content becomes theirs. For the privilege of letting Aunt Mary in Dallas look at your raft of pix, they can do what they want with them. While looking at a shot taken by “Don Smith” I was linked to a page by GettyImages for permission to use the photo. Hmm, it was royalty free, but  a 153KB file would cost me $5.00, a 502KB version $35.00 and on down the line of resolutions topping out at 47.5MB for $350.00. I wonder if Mr. Smith sees any of that. No, since Flicker now has the rights.

    Good comments guys. I’m not a lawyer (although I play one on TV), so I can’t dissect this further. The main message was to read the terms that come with all the applications. The Apple terms drone on for 57 pages. If you ever want to use iTunes, you pretty much have to go with the flow and hope Steve Jobs (and the Easter Bunny) are out for your good. I keep getting hit to agree to their PING terms. No way. If you agree to PING and Genius, you are pretty much opening your garage door and allowing the truck to back up and take what they want. I give a lot of talks and have gigabytes of pix I’ve taken. I’d prefer that other authors and speakers get their own. The ones I post on the blog are cut down to lower rez so they would look like crud in a decent publication. It’s ez to do a screen grab of anything and Photoshop can remove watermarks. Guess that’s the word we live in. I just don’t want to put my hand in my pocket and find someone else’s hand in there too!

    I’ve used Flickr for over 4 years. I mark all of my photos “private”, which means they can only be viewed by Friends & Family members. These people have either set up a Flickr login, so they can see my photos, or I create a special link to send in an email that lets them look at just the one set of photos – not my whole photostream. Flickr may assume ownership, but so far as I know a general search for Half Dome will not include my pictures. The main problem I have with Flickr, is that it’s the only place where I’ve entered the detail about the photo – where, who, when, what, etc. It doesn’t transfer back out of Flickr very well – takes a lot of special software & fiddling with mapping fields – so if I quit Flickr, I loose all that. There’s no way I could tell you exactly where my shots of New Zealand were taken, for instance, now that it’s been 4 years past. I hate being beholden like this.

    Looking into the Getty Images option Rick, it looks to me as though that is something you opt into…you can flag up your photos and if the editors at Getty think you work is good enough they may invite you to add your work.

    You need to agree to a contract allowing Getty to license your work on your behalf…but nothing of yours can go on there without your say so.

    I can’t see anything to suggest that Yahoo! can sell your work.

    Are you sure Rick?

    Section 8(b) of the UK terms does say you grant them rights but “solely for the purpose of displaying, distributing and promoting the specific Yahoo! Group to which the content was submitted”

    To me that means they can’t use your work just anyplace or sell it but they can use it to promote Flickr?
